What does the ban on double representation mean?

 

The main obligation of the real estate broker is to promote and protect the interests of his clients as well as to act loyally towards them. He must make sure not to divulge the confidential and strategic information of his clients. Also, each client has the right to benefit from the objective and independent advice of his real estate broker.

When the real estate broker has a brokerage contract with each of the two parties (buyer and seller or landlord and tenant), he is in an exceptional, unforeseen or unforeseeable situation of dual representation. The real estate broker cannot fulfill his ethical obligations to promote and protect the interests of his two clients as well as to act loyally towards them, because their interests are opposed. This is the reason why double representation has been prohibited since June 10, 2022.
